"Wrong name" in Fahrzeugbrief

Dear all -

Another story from the offices of the Spanish Traffic Authorities ;-/

When importing a car from Germany into Spain, this was the scenario:

Leasing company A buys the car new
A leases the car out to the consulting company B
The Fahrzeugbrief is issued in the name of B
When the lease is completed, B returns the car to A
A sells the car to a private person C
C sells the car to me

So, along to the traffic authorities in München... I do "all the right things" as usual, and get my ausführkennzeichen valid for 4 months, pay my german fees and taxes, and the car is de-listed from the german vehicle register. Off we go to Spain.

In Spain, when asking for the registration of the car on Spanish plates, the Spanish Traffic Authorites gets their big hang-up: The name in the Fahrzeugbrief is B, and not C - and takes the car into their deposit.

I can provide the initial purchase receipt when A bought the car, and the sales contract when A sold the car to C, but as long as B is listed in the Fahrzeugbrief, the Spanish Traffic Authorites could'nt care less ...

I have been in contact with the leasing company A and the consultant company B, but due to "company regulations and discretion" they would not release any certified copy of the leasing contract that existed between A and B (a frame agreement covering a lot more than just "my car"😉.

So what could be done ... ? Any suggestions ?

I come to think of the possibility to re-enter the car into the German vehicle register (re-import) as the only way to have a new Fahrzeugbrief issued? And then with this new Fahrzeugbrief (with the correct name of Mr C this time) try again to take the car to Spain... But my problem is, then I cannot present the car for the German Authorities (just can get current pictures and a confirmation I guess from the Spanish Traffic Authorites that the car is "safley stored" in their deposit.

Any help or advise that leads to the "recovery" of this car, would be rewarded!

Eine andere Geschichte von den Büros der spanischen VerkehrBehörden;-/

Wenn ein Auto aus Deutschland in Spanien importiert wird, dieses war das Drehbuch:

1) Leasinggesellschaft A kauft das neue Auto

2) A Mieten das Auto heraus zur beratenen Firma B

3) Das Fahrzeugbrief wird im Namen B herausgegeben

4) Wenn die Miete durchgeführt wird, B bringt das Auto zu A zurück

5) Verkäufe das Auto zu einer Privatperson C

6) C verkauft das Auto an mich

So entlang zu den Verkehr Behörden in München... Ich "alle rechten Sachen", wie üblich, und erhalten Sie mein ausführkennzeichen gültiges für 4 Monate, zahlen Sie meine deutschen Gebühren und Steuern, und das Auto wird vom deutschen Trägerregister De-verzeichnet. Weg von gehen uns nach Spanien.

In Spanien beim Bitten um die Ausrichtung des Autos auf spanischen Platten, der spanische Verkehr Authorites erhält ihren grossen Hängezustand: Der Name im Fahrzeugbrief ist B, und nicht C - und Nehmen das Auto in ihre Ablagerung.

Ich kann den Ausgangserwerb Empfang zur Verfügung stellen, als A dasAuto kaufte, und der Verkaufsvertrag, als A das Auto an C verkaufte, aber solange B wird im Fahrzeugbrief verzeichnet, die spanische Verkehr Authorites konnte nicht weniger sich interessieren ...

Ich bin in Verbindung mit der Leasinggesellschaft A und derBeraterfirma B gewesen, aber wegen "der Firmaregelungen und -diskretion" würden sie keinezugelassene Kopie des Mietsvertrags freigeben, der zwischen A und Bbestand (eine Rahmenvereinbarung, die ein Los mehr als gerade "meinAuto" bedeckt).

So, was getan werden könnte... ? Irgendwelche Vorschläge?

Ich komme, an die Möglichkeit zu denken, um das Auto in das deutscheTrägerregister wieder einzutragen (reimportieren Sie), wie dieeinzige Weise, ein neues Fahrzeugbrief zu haben herausgab? Und mit diesem neuen Fahrzeugbrief (mit dem korrekten Namen von HerrnC dieses mal) versuchen noch einmal, zum des Autos nach Spanien dannzu nehmen... Aber mein Problem ist, dann kann ich nicht das Auto für die deutschen Behörden darstellen(kann gegenwärtige Abbildungen und eine Bestätigung gerade erhalten,die ich vom spanischen Verkehr Authorites schätze, daß das Auto"gespeicherte safley" das in ihrer Ablagerung ist.

Irgendwelche helfen oder raten dem führt zu die "Wiederaufnahme"dieses Autos, seien belohnt Sie!

Really crazy story.

I think it would be a good idea to invest some money in a good Spanish lawyer who is familar with European Import/Export Rights.

A lot of former leasing cars are being exported every day to all countries and I think also to Spain.

So I think this sitation will be not the first all time for your car registration authorities. Maybe they want to annoy you...

Yep, I have also come to believe they just are having a good time annoying me ... And on that note, I already have a lawyer that have been doing this import business for a lot of cars earlier, but no she is Mrs Helpless herself, and ... I suspect her to have turned into this non-sense mode just to anny me, too ..

Well, their key point is that the original Fahrzeugsbrief (with the corner cut, since the car is exported properly out of Germany) that follows my car this time, does not list the "owner name" I have in my purchase contract (due to the story above).

So ... I'm stuck ;-(

PS: Last friday I was admitted a visit to the police deposit, and was allowed to meet my car & see that it still existed ;-) I have only been struggeling with this issue since April 6 2004 you see ...

Would there be any way to get a new purchase contract showing the "right" owner name? If you will explain the situation to the seller, perhaps he will help you and send an new contract copy by mail to you.

Yep, that was an option, since making a "fake sales contract" seemed to be a OK way to make it around their claim for "wrong name" -

However, a new rule was introduced here in Spain this spring:

"When the name in the Fahrzeugbrief is a company, then the extra requirements of the purchase contract is:

- official invoice with name of company
- EU tax id specified
- VAT treatment specified"

I have checked with the company that has its name in the Fahrzeugbrief, and there is no way for them to make this "fake sales contract", since it involves all this official information.

If I only got a copy of their leasing contract with the leasing company, everything was cool, but they cannot release such copy ... due to secresse ... Sic!
